Covee Sports Terms & Conditions

1. General
1.1. The following terms and conditions apply to all orders placed by the customer (hereinafter referred to as ”you”) with Covee Sports hereinafter referred to as “Covee” or ”we”, at www.covee.nl (also referred to as the ”website”) and in-store.
1.2. By using this website and/or placing an order you agree to be bound by the terms and conditions set out herein (the ”Terms”).
1.3. Please make sure you have read and understood the terms and conditions before placing your order. Available at www.covee.nl
1.4. We reserve the right to amend these Terms from time to time without prior notice to you. The version of the Terms that will apply to your order will be those on the website at the time you place your order.
1.5. Any court proceedings brought in relation to these Terms must be heard within the Netherlands.
2. Prices and delivery charges
2.1. The prices displayed at covee.nl include the statutory Value Added Tax (with the exception of the Wholesale Shop, but do not include a delivery charge.
2.2. The delivery charge for each order depends on the size or weight of your order.
3. Ordering / conclusion of contract
3.1. The ordering options available to you are via our website or in-store.
3.2. Only persons over eighteen years of age can place an order.
3.4. Once you have placed your order, if you have supplied us with your email address, you will receive an email confirmation. If for any reason we are unable to fulfill your order, we will let you know at the earliest opportunity. If payment for an order is processed and if we have already accepted payment for the order, this will be refunded to your account or the card which you made payment.
4. Delivery
4.1. Covee exercises the utmost diligence in accepting and processing orders and will endeavour to deliver your order to an address anywhere in Europe.
4.2. Covee endeavours to despatch orders in the fastest possible time and in the order in which they are placed. We aim to deliver within 2 days within Holland and 5 working days within Europe. However, delivery times depend on (local) delivery companies and Covee is not responsible for delays caused by these companies.
4.3. Once you have placed your order, you will receive a confirmation by email. If this confirmation is incorrect you have the option to cancel the order.
4.4. For packages that cannot be delivered after several attempts, Covee reserves the right to charge 8,00 euro for Dutch orders and 17,00 euro for European orders for costs arising.
4.5. If an order is returned to Covee because of a fault by the customer, i.e. an incorrect delivery address or not being able to accept the delivery, then the customer will have to pay the same shipping costs again to have the order re-shipped.
EVERYthing that is returned to Covee MUST be shipped in boxes with correct postage. Shipments without postage will not be accepted.
If the reason for returning the product is Covee’s fault, for example an incorrect item that has been shipped, then the costs for postage will be reimbursed by a credit or payment.
If the reason for returning the product is the customer’s fault, or an exchange, then the costs for postage will need to be fully paid by the customer. In case of an exchange, Covee then pays for re-shipping.
4.6 Orders with customised items such as items with team logos or items with specific requirements, such as women sizes, sizes larger than XXL are processed after payment and cannot be canceled/adjusted once payment has been received and cannot be cancelled or returned.Orders for customized items are final and cannot be canceled/adjusted once payment has been received.
5. Distance Selling Regulations
5.1. Under the Distance Selling Regulations you have a ”cooling off” period of seven working days (beginning the day after confirmation of your order) to cancel your order and receive a refund of the returned products, excluding shipping and return costs. This only applies to orders placed on Covee’s website and not in-store.
5.2. If you wish to cancel your order, you have to create a return in your online profile on the Covee website. We will provide a full refund of the returned products, excluding shipping and return costs within 14 days of receiving the return.
The maximum amount of the refund does not exceed €400,00 per order.
After the 7-day "cooling off" period, a new and unused product can only be returned within 21 days in exchange for a store credit.
6. Returns Guarantee
6.1. Unused in-store purchases can be exchanged for another product or a credit can be given until 21 days after purchase. Covee does not refund money. Items can be exchanged for other products or a store credit.
6.2. If you decide to return any items, you must notify us in advance by email. Items returned without prior notice will not be accepted. You must pay postage for returning the product as Covee will pay postage for shipping the other product back to you.
6.3. Orders with customised items such as items with team logos or items with specific requirements, such as women sizes, sizes larger than XXL, or items that are ordered especially for the customer, cannot be cancelled or returned.
7. Payment methods
7.1. You can enter your payment details at the time you place your order using a valid credit card (VISA, MASTERCARD). Payment will not be taken from your card until the goods are dispatched. PayPal and bank transfers are also accepted methods of payment.
7.2. Covee reserves the right to check the validity of the credit card, and whether the address data of the purchaser is correct. We may refuse orders depending on the result of the checks.
8. Our Liability
8.1. We do not accept liability for death or personal injury caused by our negligence or that of our employees and agents. We do not seek to exclude liability for fraudulent misrepresentation by us or our employees or agents.
8.2. If we breach these Terms, we shall only be liable for losses which are a reasonably foreseeable consequence of such breach. Losses are foreseeable where they could be contemplated by you and Covee at the time you placed your order.
8.3. Covee is not responsible for:
• Delays or problems caused by its suppliers or other companies.
• indirect losses which are a side effect of the main loss or damage and which are not reasonably foreseeable by you and us at the time you placed your order, for example loss of profits of loss of opportunity; or
•failure to deliver the goods or to meet any of our other obligations under these Terms where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident, terrorist activity and acts of God.
8.4. Our total liability to you for any loss or damage arising in connection with this Agreement shall be limited to the total price of your order.
8.5. Nothing in these Terms is intended to affect your statutory rights.
9. Team Pages
9.1. When a custom-made product has been ordered with team logo, Covee can use this logo to create a team page on Covee’s website. Covee is the sole owner of this page at all times and regulates its contents. Covee welcomes input in regards to this page, but is not obliged to implement it.
10. Protection of privacy
10.1. The Data Protection Act 1998 sets out requirements for how we store and disclose your personal information. Covee assumes responsibility for all personal information that you make available to us. The details are used for verifying, accepting and processing delivery agreements and for managing the customer relationship thereby arising, pursuing outstanding payments, combating fraud and misuse and complying with statutory regulations. The information is also used with your consent for Covee’s marketing activities.
11. Colors
If there are colour differences between the colours shown on the website on your computer and the actual colours of the garments, this may be due to the colour reproduction on your computer.
12. Guarantee/Warranty
Covee Sports has to follow the warranty rules set by its suppliers. We cannot make any exceptions.
What to do with a broken product?
If you, after reading the below warranty conditions, think that your product should be replaced, you can contact Covee Sports B.V. by email: info@covee.nl Items that are returned without permission will not be processed.
Covee will have to be notified of the defective product as soon as possible and within the warranty period. All notifications after the warranty period will be disregarded. For example, a customer notifies Covee after 3 months about a bat that supposedly broke 2 weeks after purchase: this will not be accepted.
Items that are replaced by Covee under warranty are shipped with no extra costs in The Netherlands. If the customer lives outside The Netherlands, the item is replaced, but not shipped for free. The customer needs to pay these shipping costs, or place a new order so that the new item can be included with that shipment.
BATS:
Easton, Louisville Slugger and DeMarini (Wilson) do not offer any warranty when the bat has been purchased outside of the United States. Covee does not agree with that policy, so Covee offers a 1-month warranty on cracks, dents, and breaks in aluminium bats. After the 1-month period, there is no warranty on aluminium bats. There are no exceptions to this rule. Smalls dents and “noises” may appear, but that does not influence the quality of the bat and are therefore not considered as warranty issues.
IMPORTANT: Aluminium bats are very sensative to temperature changes. The suppliers do not allow the players to use aluminium bats below 15 degrees Celcius. There is absolutely no warranty on bats that are used in cold weather.
A bat is designed to only be used with real gameballs. All bats are excluded from warranty when they are used on a pitching machine.
Some bats are only designed to be used in certain age groups or certain sports. For example, there are bats that are only to be used by the smallest age groups using safety balls or Fastpitch softball bats that can only be used by women. Any bats used by other age groups or gender will not have any warranty.
GLOVES:
There is a 3-month warranty on cracks and production errors on leather gloves. Laces have no warranty and a glove with a broken lace is therefore not considered as broken.
SHOES:
There is a 1-month warranty on production errors. Possible production errors: broken cleats, torn soles, etc. Broken- or damaged noses do not fall under warranty, nor do shoes that have been “spiked”.
BATTING GLOVES:
There is a 1-month warranty on production errors.
UNIFORMS:
There is a 1-month warranty on zippers and buttons. Covee guarantees delivery with no color difference. Items with color differences after delivery have no warranty.
BAGS:
There is a 1-month warranty on zippers and straps.
14. Severance
If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the other Terms shall continue to apply.
15. Ownership of rights
All rights, including copyrights at www.covee.nl remain with Covee Sports B.V. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of Covee.
